Fair Use & A Different Quality of Light . . .

I see that Gatehouse and Boston Dot Com have settled their case. Dan Kennedy seems to have grasped the crux of the issue involved.

But I would add that what Boston was doing even seemed to dehumanize the Gatehouse journalists who were gathering and constructing those stories which Boston was then "harvesting" with a machine-like brutality.

I think Jeff Jarvis has been too hard on Gatehouse.

Where did it all go so wrong? Right from the start, I'd say. The other newspapers who are "sharing" content got together and discussed it first, which gave them a chance to put their terms and stipulations on the table and arrive at some agreement of what would be acceptable or not acceptable to them.
