Mez: Scapegoat Exits (3#) -

Meredith Kercher Murder Case -

Amanda Knox’s family is complaining that the Prosecution submitted an appeal in order to harass them, but a new prosecutor is being assigned to the case for the appeal process, according to Barbie Nadeau's latest dispatch over the weekend.

Andrea Vogt reports that Judge Emanuele Medoro
is set to preside over the upcoming proceedings.

And a lawyer for Amanda Knox claims Defense has a new witness who can prove that Knox and Raffaele Sollecito were not present at or involved in the homicide, according to an ABC TV report.

Commentary . . .

It looks like the appeal will enable
both sides to refine and fine-tune their cases.

What role does Motive have in this process?

Motive belongs to the detectives. It is a potential tool they can use to help them solve a case. It is often grouped as: motive, means and opportunity.

But it does seem that the primary reason
for the killing is under contention here.

According to the verdict, Deracination was the primary reason: youth, apart from their parental authorities, befogged by drink and drugs, etc.

Prosecution seems to be counter-arguing with
a depiction of the killing as a lark or caper
done for depraved entertainment.

The Court took a more benign view of the
youngsters, while the Prosecution posits a darker view.

Don't expect the next prosecutor to be a creampuff. Although the Perugia prosecutor was often used as a scapegoat by Knox sympathizers, the next prosecutor is just as likely to be a no-nonsense, grim juggernaut.
